Step Parent Adoptions

We at King, Koligian & Associates limit our adoption practice to step parent adoptions. A step parent adoption is when a minor child is adopted by the spouse of his or her custodial parent. Grandparent or other relative adoptions are not considered step parent adoptions. In addition, in order to be eligible for a step parent adoption, the petitioner must be married to the parent, and the child living with them for a minimum of six months. A home study is typically required, and the child's wishes are often considered. If the other parent of the child is known and living, he or she must be provided notice of the pending step parent adoption, and in some cases consent might be required. There are situations where the consent of the parent that does not have custody is not required. Additionally, if the child to be adopted is more than 12 years old, his or her consent must be obtained as well.
